H-1: Temporary Worker of Distinguished Merit and Ability (Scholars)
H-1 scholars are admitted to the U.S. until the date noted on their Form I 171C or I-797 and Form I-94.
H-1 temporary workers may only work for an employer who has submitted the petition for H-1 classification approved by USCIS according to the terms and conditions of that petition. A copy of the petition (Form I-129) and approval ( Form I-171C or I-797) are on file in the departmental office. No other employment is permitted.
H-1 temporary workers must obtain the original Form I-797 (approval notice) from their department and present it to the Immigration Office at the port of entry along with a passport and valid visa stamp in the passport.
